Federal authorities may prosecute sick people whose doctors prescribe marijuana to ease pain, the Supreme Court ruled Monday, concluding that state laws don't protect users from a federal ban on the drug.
So here is the biggest question --
Where were these justices, so willing to enforce federal law over state law, when the Terri Schiavo case came before them? I fail to see any meaningful distinction. Both cases involved conflicting federal and state law -- what was the essential element in the marijuana case that casued them to not only hear it, but rule in favor of the federal laws, that was not present in the Schiavo case?
